The purpose of this article is to explain the criminal responsibility in different states of dementia and the effect of mental disorders on crime. The data collection is in the form of libraries in the form of data capture and analytical descriptive analysis. In this regard, the madness and the spiritual element of the crime and the criminal process were investigated. In addition, the criminal responsibility of the insane in criminal law was discussed and the criminal liability of the mentally retarded, mentally retarded, mentally retarded, mentally retarded, and other mentally retarded. Investigations showed that one of the cases that may occur during criminal proceedings is the accused madness. Since insanity is considered one of the factors responsible for criminal responsibility and insane is unable to understand the behavior of the perpetrator, it is a matter of jurisdiction and, depending on the stage at which the insanity occurs, the judicial decision It will be different and will lead to prosecution, delay, prosecution and so on. Various types of psychiatric disorders other than dementia are among the topics in criminology that can have a significant impact on the criminal responsibility of criminals and sufferers of these disorders and consequently on criminal rights. Nowadays, Islamic Penal Code has introduced insanity (not other mental disorders) as a factor in the elimination of criminal responsibility by invalidating previous laws. While the achievements of the medical sciences, especially psychology and psychiatry, indicate that some of the disorders due to the deprivation of power, the perception and the will to destroy the criminal responsibility, some of the disorders due to the influence and Applying pressure on reasoning, understanding and the will to reduce criminal responsibility, and some for not affecting one's perception and will, although endangering his mental health but not affecting his criminal responsibility.
